The volume investigates the functioning of the courts through an analysis conducted on the double bottom richest of causes existing in Italy, that of the Venetian court in the period from 1420 to the opening of the Council of Trent. As for the subject and chronological period covered, it is the first Italian study related to the topic, and has as some previous work on the courts of England, France and Germany, with which it is in a constant dialogue. As matters concerning the health of the soul, marriage came to form part within the competence of the Church, which in the eleventh century it assured the jurisdictional monopoly now running it in tune now in conflict with the secular authorities, by virtue of the civil consequences of marriage - first of all, the legitimacy of children. The courts were competent for matters between the spouses, in which the Church sometimes interfered in a direct manner, replacing them, and indirectly influencing the provisions by its own judgments. The secular courts, in turn, eroded part of the ecclesiastical powers continuing to exercise an autonomous jurisdiction on marriage, especially concerning the separation and crimes closely related to the nuptial bond and its definition, such as adultery, bigamy, rape. The book is divided into two sections - the organization of the court and dialogue between judges and users in relation to matrimonial matters - followed by an appendix that the income of the quantitative results of the survey. It offers the reader a highly representative of the changes that the Council of Trent introduced on a bed secular practice, relegating it to the experience of marginality and deviance to almost erase the memory.
